These Terms of Service ("Terms") govern your use of ChartPen, operated at chartpen.com and app.chartpen.com. By using ChartPen, you agree to these Terms.

1. Service Description

ChartPen is a browser-based chart annotation and drawing tool designed for trading educators. It allows users to import chart images, annotate them with professional drawing tools, and export clean branded images.

2. Accounts

• You may use ChartPen without an account (free tier with local storage).
• To access Pro features, you must create an account using email or Google Sign-In.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use ChartPen.

3. Free and Pro Tiers

Free tier: All drawing tools, local save (up to 3 projects), PNG export with ChartPen watermark.

Pro tier: One-time lifetime payment. Includes no watermark, cloud sync, unlimited projects, recording & playback, market simulation, GIF export, and custom branding. See our pricing page for current pricing.

4. Payments

• Pro access is a one-time lifetime purchase (not a subscription).
• Payments are processed securely by Stripe.
• "Lifetime" means for as long as ChartPen operates as a service.
• We reserve the right to introduce new subscription-based features in the future. Lifetime Pro users will retain access to all features included at the time of their purchase.

5. Your Content

• You retain full ownership of any charts, drawings, annotations, and images you create or import into ChartPen.
• We do not claim any rights to your content.
• You are responsible for ensuring you have the right to use any images you import (e.g., broker chart screenshots).

6. Acceptable Use

You agree not to:

• Use ChartPen for any illegal purpose
• Attempt to reverse-engineer, decompile, or hack the service
• Automate access to ChartPen (bots, scrapers) without permission
• Resell or redistribute ChartPen as your own product
• Use ChartPen to create or distribute misleading financial advice presented as guaranteed outcomes

7. Intellectual Property

ChartPen's code, design, branding, and documentation are owned by us and protected by copyright. Your purchase of Pro grants you a license to use the service — it does not transfer ownership of any ChartPen intellectual property.

8. Disclaimer

ChartPen is an annotation and drawing tool. It does not provide financial advice, trading signals, or investment recommendations. Any charts or patterns drawn using ChartPen are for educational and illustrative purposes only. We are not responsible for any trading or investment decisions made based on content created with ChartPen.

9. Service Availability

• We strive to keep ChartPen available 24/7, but we do not guarantee uninterrupted service.
• We may perform maintenance or updates that temporarily affect availability.
• We are not liable for any data loss. We recommend exporting important work regularly.

10. Limitation of Liability

To the maximum extent permitted by law, ChartPen and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for Pro access.

11. Termination

• You may delete your account at any time.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your cloud-saved data will be deleted. Local data in your browser is unaffected.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of ChartPen after changes constitutes acceptance of the updated Terms. We will notify users of significant changes via email or in-app notice.
